Terms and Conditions

These Terms of Use and Conditions of Sale establish the general clauses applicable to the use of our website www.chule.pt and purchases made in the respective online store, hereinafter referred to as “Terms and Conditions ”.

Before using our website and purchasing from our online store, carefully read these Terms and Conditions, as well as consult our Privacy Policy and Cookies Policy.

Using our website and online store implies that you agree to these Terms and Conditions and the Privacy and Cookies Policies. If you do not agree with its content, you should not use the site.

  1. Who are we?

The website www.chule.pt is owned by the limited liability company JMGW - THE PORTUGUESE TEXTILES, LDA, with headquarters at Avenida das Industrias, 63, Alto de Colaride, 2735 - 213 Agualva-Cacém, Distrito : Lisbon Municipality: Sintra Parish: Agualva and Mira-Sintra, with the legal person identification and registration number 515757802, which we call JMGW for short.

  1. Processing of your personal data

All data provided by our visitors and customers and information collected about them will be treated in accordance with our Privacy Policy and Cookie Policy.

  1. Responsible use of our website

Our visitors and customers are committed to complying with applicable legislation, refraining from using our website to pursue any purposes contrary to the law or good customs, or legitimate interests or rights of third parties.

Use of our website can be done through your customer session, after authentication of your customer account created for this purpose, or without being logged in (guest).

In any case, users and customers undertake to provide true and complete information, refraining from placing false or fraudulent orders.

Users who create an account undertake not to disclose their access data, preventing its use by third parties.

They further undertake not to share offensive, obscene, inappropriate or xenophobic content, or that in any other way constitute a violation of the Law, good customs or public order.

  1. Industrial and Intellectual Property

The use or reproduction, in whole or in part, of any and all textual, visual and sound elements presented on our website is strictly prohibited, as they are protected under industrial and intellectual property rights, unless prior written authorization is provided

JMGW is not responsible for any abusive behavior on the part of its visitors or customers that offends the rights to brands, patents, logos or designs held by third parties.

  1. Product information, price and availability

Each of the products sold in our online store has its own presentation page where all information regarding its essential characteristics is provided, accompanied by representative photographs of the product.

All products presented in our online store are accompanied by their respective price, which is indicated in euros and includes fees and taxes. The applicable VAT rate is that in force at the date of the order. The costs associated with transportation are added to the total value of the products and will be presented before completing your purchase.

It may be the case that the prices shown are abnormally low or exorbitant, which will constitute a clear error. If so, we will contact you so that you can reconfirm your order at the normal price or conditions or, if you do not wish to do so, we will cancel that order. If we are unable to contact you, we will cancel the order and refund the entire amount paid.

The products presented on our website are subject to their availability in our warehouse. Therefore, it may happen that some of the products you ordered are out of stock. If this is the case, we will refund the amount paid for these products within 30 days.

The prices, campaigns, offers and other conditions associated with the products in our online store apply exclusively to orders placed on our website www.chule.pt and may be changed without prior notice. 

 Payment, delivery, execution methods, the deadline on which the professional undertakes to deliver the goods or provide the service, and, if applicable, the system for handling consumer complaints by the supplier of goods or service provider

    6.  Payment Methods

At CHULÉ® we want you to make your purchases in a simple and practical way.

To facilitate this process, we want you to use the payment method that is most convenient for you, always safely and quickly.

You can use any of the following payment methods:

  • Visa;
  • Mastercard;
  • American Express;
  • Paypal;
  • Apple Pay;
  • MB References;
  • MB Way.

     7. Delivery

Our goal is to deliver your orders to you in the shortest amount of time.

In any case, we undertake to deliver your order within a maximum period of 30 days from the dispatch of your order. Alternatively, we also offer the option of delivery to some physical collection points.

If for reasons that are not attributable to us it is impossible to deliver the order to you, we or the carrier will inform you of all the details so that you can collect it.

As soon as the customer or a third party indicated by you, other than the carrier, receives the goods, the risk of loss or damage to those goods passes to you.

If you want delivery to be made by another carrier other than our associates, this risk of loss or damage passes to you as soon as the order is delivered to the carrier chosen by you.

       8. Returns, exchanges and refunds

1. Free termination of the Contract

    If the customer is a consumer, they can terminate the contract without having to provide any justification up to 14 days after receiving their order at the indicated address.

    If the order is split and the products in a single order are delivered at different times, the 14 days count from the moment the consumer received the last product.

    To exercise your right to withdrawal, you must inform us of your intention within the period indicated above by post or email. You can use the attached form or any other means in addition to those indicated.

    Products must not have been used and must retain all original packaging, in the condition in which they were received. If the product is not kept in the conditions necessary for its refund within 14 days from the date on which you communicate your intention to terminate the contract, this termination will not take effect.

    You may be held responsible for the depreciation of the value of the asset resulting from its handling beyond what is necessary to verify its nature, characteristics and condition.

    There is no right to free termination of the contract when dealing with products that have been produced or personalized by the customer or when dealing with sealed items whose opening prevents their return for hygiene reasons.

    If you terminate the contract, we will refund the amount spent, minus the costs associated with delivering the products.

    The refund will be made using the same payment method used by the customer in their order, within 14 days of receipt of the products at our facilities.

    2. Exchanges

    Within the same period of 14 days from receipt of the order, you may choose to exchange the item for another of equal or lesser value, which must be in the same condition in which it was received.

    If the product is of higher value, payment of the respective difference must be made.

    The product you wish to exchange must be sent to our facilities, accompanied by the attached form, which must be completed stating the reason why you wish to exchange it.

    3. Defective or damaged products

    If the ordered items have manufacturing defects or are damaged, they may be returned and the cost will be fully refunded, including shipping costs, if any.

    Acceptance of the return depends on the inspection of the goods and the origin of the defects, following which a report will be drawn up on the admissibility or otherwise of the return.

    Amounts paid for items returned due to damage or defects, if any, will be refunded in full, including delivery costs related to sending the item and the costs of returning it, unless the customer wishes to replace or exchange of product.

    If you choose to replace or exchange the product for another of higher value, you will be charged the amount corresponding to the price difference. If it is a product of equal or lesser value, we will send you the product at no cost, providing any refunds to which you are entitled.

    Regardless of your choice, the refund will be made using the same payment method used in your order, within a maximum period of 30 days.

        9. Guarantees

    All products sold in our online store that do not comply with the contract are covered by a 2-year warranty.

        10. Applicable law and forum

    These Terms and Conditions and all contracts concluded in our online store are governed by Portuguese law and all disputes arising from them will be resolved exclusively in Portuguese courts.

        11. Alternative dispute resolution

    In the event of a dispute initiated by a consumer against a supplier of goods or service provider and respecting contractual obligations resulting from purchase and sale or service provision contracts, concluded between an established supplier of goods or service provider and consumers residents in Portugal and the European Union.

    The Consumer Arbitration Network which integrates consumer dispute arbitration centers authorized to carry out information, mediation, conciliation and arbitration activities in these disputes is made up of the following centers:

    National Center for Information and Arbitration of Consumer Conflicts (CNIACC);

    Consumer Conflict Arbitration Center of the District of Coimbra (CACCDC);

    Lisbon Consumer Conflict Arbitration Center (CACCL);

    Arbitration Center of the Autonomous University of Lisbon (CAUAL);

    Consumer Dispute Arbitration Center of the Autonomous Region of Madeira (CACC RAM);
